Rabbi Zalman Shimon Dworkin and the earlier local position

Rabbi Zalman Shimon Dworkin served as the mara d'asra of Crown Heights during the Rebbe's leadership. His name appears on the Kislev 5739 proclamation of the Union of Orthodox Rabbis warning against eruvin in New York and other large cities.

The Crown Heights psak signed by Rabbi Avrohom Osdoba and Rabbi Shlomo Yehuda Halevi Segal identifies Rabbi Dworkin's ruling as the earlier position for the neighborhood. Rabbi Osdoba and Rabbi Yosef Yeshaya Braun repeated that identification in 5782 and 5783 when they described the position of the successive local Rabbonim as categorical rejection.

The Beis Din's instruction before the new boundary was publicized

The Badatz's day-by-day guides for Tishrei 5776 were published in September 2015. They state in ordinary practical instructions that Crown Heights has no eruv and that carrying is forbidden. The Yom Kippur guidance repeats the prohibition for the fast day.

These guides were not written as an answer to a publicity campaign. They reflect the standing practice taught by the Beis Din before the new arrangement became a public issue the following spring.

The Rabbonim serving in 5776

Rabbi Aharon Yaakov Schwei and Rabbi Yosef Yeshaya Braun signed the first public Beis Din notice after the eruv was announced. It calls carrying absolutely forbidden and treats the arrangement as nonexistent. They also insisted that the decision belongs to the Rabbonim who know the conditions of Crown Heights.

Rabbi Avrohom Osdoba then issued his own signed clarification. He denied that his earlier correspondence gave permission to build and wrote that it had never entered his mind to agree to an eruv in Crown Heights. His later joint psak with Rabbi Shlomo Yehuda Halevi Segal prohibited carrying throughout the neighborhood on Shabbos and Yom Kippur.

Different Rabbonim signed different pages. The continuity lies in what each of them said about carrying and the proposed eruv, not in presenting every name as a signer of one collective sheet.

The later Beis Din notices

After Rabbi Schwei's passing, Rabbi Osdoba and Rabbi Braun again set out the position of the local Beis Din before Sukkos 5782. They included Rabbi Schwei and Rabbi Dworkin in the succession of local Rabbonim whose position was one of categorical rejection.

When purported exterior walls beyond Crown Heights were introduced as a new basis for the route, the same two Rabbonim ruled that the proposal made no change whatsoever to the psak (20 Teves 5783). Before Yom Kippur 5786, the Beis Din once more prohibited carrying and transferring between domains throughout Crown Heights and its vicinity.

The physical proposal changed and the public explanations changed. The local psak did not.
